Terms of Use

Please read these terms carefully. They set out our and your legal rights and obligations in relation to services offered by Pixlnexs.

The Product

  • Deliver the product as per the specifications in the Scope of Work.
  • Keep the customer informed on progress within the agreed timescales as each phase completes. If unforeseen extensions arise from technical complications or staff absence, they are communicated through the ticketing platform and the revised timeline is approved by email, or an alternative solution is agreed.
  • Provide access to a demo server during the delivery and acceptance phase.
  • Make design modifications as outlined in the delivery and acceptance criteria where specified in the Scope of Work.
  • Prepare and release the design to be installed by the customer.
  • Pixlnexs sells products, not services. Additional features or variations from what was demonstrated are treated as customisations and charged at USD 25 per hour.

Communication

Support is provided via support ticket at support@pixlnexs.com. Telephone and live chat support is limited to the Pre-Sales department.

Delivery and Acceptance

Pixlnexs will use all reasonable endeavours to deliver the project for acceptance testing on or before the agreed date. During the acceptance period the customer tests via an online demo server to determine:

  • The design conforms in all material respects with the original specification in the Scope of Work.
  • Whether the product has any defects.

Charges and Payment

Pixlnexs will not charge more than the amount previously agreed unless the customer varies the specification, features or designs from those shown in demos. Changes that increase cost are not undertaken without prior written authorisation. A 100% deposit is payable before the project starts. Updates are provided as per the agreed deadlines.

Offers and Proposals

Offers and proposals made by Pixlnexs are confidential and remain the property of Pixlnexs. They, and the information within them, must not be passed to third parties or publicly disseminated without prior written authorisation. This includes technical features, functionality, aspects of the design and pricing.

Supply of Materials

The customer supplies all materials and information required to complete the work to the agreed specification, including photographs, written copy, logos and other printed materials. Where a failure to supply materials delays completion, Pixlnexs may extend agreed deadlines by a reasonable amount.

Intellectual Property Warranty

The customer obtains all necessary permissions and authorities for the use of all copy, graphic images, registered company logos, names, trademarks and any other material supplied to Pixlnexs for inclusion in the project.

Concluding a contract is regarded as a guarantee by the customer that all such permissions have been obtained and that inclusion of the material would not constitute a criminal offence.

By agreeing to these terms the customer removes the legal responsibility of Pixlnexs and indemnifies it from any claims or legal actions related to the content of the customer’s site.

Right to Terminate

Pixlnexs reserves the right to refuse or break a contract without prior notice if it believes the client, their website or any material is illegal, immoral, outside the Scope of Work or otherwise unacceptable.

Events Beyond Our Control

Pixlnexs is not liable for breach of contract where the breach was due to software, hardware or electrical failure, natural events such as fire, or other events beyond its control.

Consequential Loss

Under no circumstances will Pixlnexs be responsible for financial or other loss or damage caused by the failure, use or misuse of its software or when accessing the customer’s website. The client should ensure that data is regularly backed up and that a contingency plan is in place.

Jurisdiction

All claims, differences and disputes arising under or in connection with the website, these Terms of Use, the agreements or any transactions entered into through the website, or the relationship between you and Bright Livingstone Consultancy Pvt Ltd, are subject to the exclusive jurisdiction of the High Courts in Chennai, India. Each party irrevocably waives any objection to venue or forum non conveniens and agrees that a judgment may be enforced in other jurisdictions.

Pixlnexs reserves the right to change the terms and conditions in this document. Under the Doctrine of Constructive Notice it is construed that the client can access this public document and all information provided here.

Refund Policy

(a) The client pays the amount stated by sales at the time of order as a one-time, upfront fee for the product delivered and rights granted. No credit is allowed under any circumstances.

(b) Once paid, charges are non-refundable. The client has satisfied themselves about the product through communication with the team and the demonstration before placing the order. After purchase the client receives complete ownership of the delivered output for the purpose it was bought, hence all sales are final. Questions should be raised by email or support ticket before purchase. If additional time is agreed and the client later loses interest, no charges are refunded.

(c) Pixlnexs may terminate support at any time if the client does not abide by the agreement or is abusive in communication. The client may terminate at any time by uninstalling or destroying the product, without entitlement to any refund.

(d) If the product model is not working on the client site, Pixlnexs will require website, server and remote login access to resolve the problem.

Before purchasing, the client is advised to carefully review all product details and reference outputs, including 3D product models and AI-generated videos, and purchase only if fully satisfied with the demonstrated quality and scope. If delivered outputs do not align with the agreed specifications or demonstrated samples, Pixlnexs will make reasonable efforts to review, revise and rework the deliverables.
